01Who we are and what these terms cover

NiraMind LLC is located at 178 Gelston Ave FL 1, Brooklyn, NY 11209, United States. You can reach us at support@niramind.com.

These terms apply to our websites and apps (together, the “Services”):

• niramind.com and its sister sites: tech.niramind.com, atlas.niramind.com, work.niramind.com and study.niramind.com;
• Compass: compass.niramind.com and the Compass app for iOS and Android;
• VBW (Virtual Business World): vbw.niramind.com and the VBW app for iOS and Android;
• Ghazal: ghazal.niramind.com and the Ghazal app for iOS and Android, a portfolio we build and host for a client;
• the NiraMind, Tech and Atlas apps for iOS and Android.

Compass also has its own Compass Terms, which say more about planning Ventures. Where they cover something these terms don’t, they apply as well.

02Free of charge

The Services are free. There are no purchases, subscriptions or in-app payments, and there is no advertising in them.

03Accounts

Compass and VBW let you create an account. The NiraMind, Tech and Atlas apps don’t need one. In the Ghazal app, only the site’s owner signs in, to its admin panel.

• You must be at least 13 years old to create a Compass account. If you are under the age of majority where you live, you need a parent’s or guardian’s permission.
• VBW is for work and hiring: you must be at least 18 years old to create a VBW account.
• VBW is by invitation: a business or another member invites you.
• Give accurate information, keep your password to yourself, and tell us at support@niramind.com if you think someone else is using your account. You’re responsible for what happens under it.
• You can delete your account at any time, in the app or on the web, as described in the Privacy Policy.

04Acceptable use

Please don’t:

• post, send or upload anything unlawful, harassing, hateful, threatening, sexually explicit, misleading, or that infringes someone else’s rights or privacy;
• send spam, or invite people who haven’t agreed to hear from you;
• impersonate anyone, or use someone else’s account;
• upload malware, or files you don’t have the right to share;
• scrape the Services, call our API outside our own websites and apps, or try to get around their limits or security;
• interfere with the Services or with other people’s use of them.

To report content or behaviour that breaks these terms, email support@niramind.com with what you saw and where. We review reports and may remove content, and suspend or close accounts, that break these terms or the law.

05Your content

You own what you add to the Services, such as Ventures, events, places you suggest and votes in Compass, and profiles, messages, files, job applications and business details in VBW. You give NiraMind a limited licence to store it, process it and show it to the people you share it with, only to run the Services. In Compass, that means everyone on a Venture. In VBW, it means the businesses and people you work or chat with.

We keep and delete your content as described in the Privacy Policy, including how long VBW keeps chat messages and files. When you delete your account, some content stays for the others who use it, without your name, as the Privacy Policy explains.

You are responsible for your content and for having the right to share it.

06Third-party content and services

• Films on Atlas and Ghazal play from YouTube, in its privacy-enhanced mode. YouTube’s own terms and the Google Privacy Policy apply to what it shows and collects.
• Photographs on Atlas come from Wikimedia Commons under their own licences. Each one is credited with its author and licence, and those licences, not these terms, set how you may reuse them.
• Maps and places in Compass come from Google Maps. By using them you agree to the Google Maps/Google Earth Additional Terms of Service.
• Ideas by Gemini in Compass are generated by AI and may be wrong, out of date or unsuitable. Weather is a forecast or a past average, not a guarantee. Check opening times, prices, safety and conditions yourself before you rely on them.
• Tech publishes reviews and news as opinion and information, not professional advice. Prices and availability change.
• Links to other websites and services take you to places with their own terms and policies. We aren’t responsible for them.

Compass helps you plan. It doesn’t sell, book or guarantee travel, lodging or activities. VBW connects people and businesses, but NiraMind isn’t a party to their dealings or employment.

07Our content and trademarks

The Services, their design, software, text, artwork and films we made, and the NiraMind, Compass, VBW, Atlas and Tech names and logos belong to NiraMind or its licensors. The Ghazal site’s own content belongs to its owner. You may use the Services for your personal use as these terms allow. Please don’t copy, modify, sell or redistribute them, or use our names or logos, without our written permission, except where the law allows it.

08Availability

We work to keep the Services running, but we can’t promise they will always be available, error-free or unchanged. Some of them are in beta. We may change, pause or end features or Services, with notice where reasonable. Please keep your own copy of anything important, such as booking details or files you upload.

09Disclaimers

The Services are provided free of charge and “as is” and “as available”. To the fullest extent the law allows, NiraMind makes no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

10Limitation of liability

To the fullest extent the law allows, NiraMind won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or plans. Our total liability for any claim about the Services is limited to one hundred US dollars (US$100). Some places don’t allow these limits, so they may not all apply to you.

You agree to hold NiraMind harmless from claims that arise from your content or from your breach of these terms.

11Your rights as a consumer

Nothing in these terms takes away rights you have as a consumer that can’t be limited by contract. If you live in the European Union, the United Kingdom or another country with mandatory consumer laws, those laws still protect you, including the courts you can use, and these terms apply only as far as those laws allow.

12Suspension and ending

You can stop using the Services at any time and delete your account. We may suspend or close an account, or end access to the Services, if it breaks these terms or the law, to protect other people or the Services, or if a Service ends, with notice where reasonable. To protect everyone, some Services automatically lock accounts that show unusual activity; if that happens by mistake, contact us and we’ll review it. The sections on content, disclaimers, liability and governing law continue to apply after your use ends.

13Changes to these terms

We may update these terms as the Services change. We’ll post the new version here with a new effective date and, for significant changes, tell you in the Services or by email before they take effect. If you keep using the Services after a change takes effect, the new terms apply.

14Governing law

These terms are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law rules. Subject to your rights as a consumer (section 11), any dispute will be heard in the state or federal courts located in New York. If part of these terms can’t be enforced, the rest still applies.
